Booking the exhibition of a film with Community Cinemas Ltd (CCL), by an
authorised person of a suitable community venue (the client), shall be subject to the
following terms and conditions.
1) Bookings:
a) On request, CCL will provide a list of films currently available and also
those expected to be available in the near future.
b) CCL will accept a booking for any film currently in general cinema
release, or expected to be in general cinema release at the time of the
proposed exhibition. Subject to confirmation of:
I. The selected film being available.
II. The selected date being available
c) A booking fee of £50 is required by CCL to secure a booking (non
refundable). This amount will be deducted from the final invoice.
d) The final charge for the exhibition will be based on the agreed price
with Community Cinemas Limited as stated on the booking form prior
to the cinema event.
2) CCL will:
a) Supply the client with an agreed number of tickets, containing details of
the venue, date, film to be exhibited and ticket price, along with other
promotional material (if applicable)
b) On the date of the exhibition, CCL’s representative /projectionist will
arrive in adequate time prior to the advertised time in order to set up the
cinema screen, sound system and projector etc. Arrival time will be
confirmed nearer to the date.
c) Provide a 15 (fifteen) minute interval, approximately half way through
the exhibition. Interval times will vary which will depend upon the
event and client in question.
d) On completion of the exhibition, CCL’s representative will:
I. Complete the final invoice based on the agreed price with
Community Cinemas Limited.
II. Dismantle the screen, sound system and projector etc and leave
the venue with all equipment within approximately half an hour.
3) The Client will:
a) Use it’s best endeavours to promote the exhibition in order to maximise
the audience number for the exhibition.
b) Provide sufficient seating for the expected audience number.
(CCL staff will set the chairs up)
c) Ensure viewing of the exhibition from outside the specific venue
location is not possible.
d) Retain all revenue generated from the sale of refreshments, raffle tickets
and film merchandise etc.
e) Ensure all audience members comply with The British Board of Film
Classification’s age restriction for the film to be exhibited.
f) Understand that unless requested otherwise, the film sound track will
operate at up to 69 decibels. The clients will have knowledge of their
audience and take responsibility for requesting an appropriate reduction
to the level of sound, should at any point they feel a reduction to be
necessary.
g) Ensure current fire safety regulations are adhered to, providing clearly
marked fire exits and ensuring adequate fire extinguishing equipment is
readily accessible.
h) Undertake to pay CCL:
Promptly pay CCL’s invoice when presented with it by CCL’s
representative/projectionist immediately following the exhibition.
Unless another payment agreement has been made.
4) Cancellation
a) Under any unforeseen circumstances, CCL may cancel the booking, or
withdraw the availability of a particular film at any time and without
notice. In such an event no compensation will be payable to the client.
CCL will however offer a selection of available alternative dates or
available alternative film titles for the client to choose from.
b) The client may cancel the booking at any time prior to tickets for the
event being printed without incurring any cancellation charge.
c) Following tickets being printed a cancellation charge will be made in
accordance with the following timetable. Cancellation within:
I. Four weeks of the scheduled date of the exhibition, a
cancellation charge of £50 will apply
II. Two weeks of the scheduled date of the exhibition, a
cancellation charge of £100 will apply
5) Liability
a) CCL will ensure that it carries adequate liability insurance to cover itself
against any claim made by any individual or organisation.
b) CCL will ensure it has the necessary licence to screen the particular film
in association with the film distributors in question.
c) The client will ensure that it carries adequate liability insurance to cover
itself against any claim made against the organisers by any person
attending the event.
6) General
a) The client shall not be entitled to assign the booking to a third party or
different venue location without the written agreement of CCL
b) Not withstanding anything contained within these terms and conditions
CCL will not be liable for any failure to perform its obligations to the
client in whole or in part as a result of any of the following
circumstances: Strikes; Other industrial actions; Civil unrest, upheaval
or commotion; Act of God; Terrorism; War.
c) No variation of these terms and conditions shall be effective unless in
writing and signed on behalf of both CCL and the client.
d) This agreement shall be subject to the Laws of the country in which the
exhibition takes place.
